• "Services" refers to the pasnexus.com website and all applications published by PAS Nexus on the Apple App Store.
• "User" or "You" refers to any individual or entity accessing or using our Services.
• "Content" refers to all text, graphics, images, software, and other materials available through our Services.
• "Application" refers to any software application published by PAS Nexus on the Apple App Store.

Our website is provided for informational purposes about PAS Nexus and its applications. By using our website, you agree that you will not:

• Attempt to gain unauthorized access to any portion of our website, servers, or systems.

In the event of a conflict between these terms and Apple's terms, these terms supplement but do not override Apple's terms. PAS Nexus LLC is solely responsible for the content, maintenance, and support of its applications. Apple Inc. has no obligation to provide any maintenance or support services with respect to our applications.

All content, code, designs, trademarks, and logos — including the PAS Nexus name and logo — are the exclusive property of PAS Nexus LLC and are protected by United States and international intellectual property laws. All rights are reserved.

"Apple," "iOS," "macOS," "iPadOS," "watchOS," "visionOS," "App Store," and related marks are trademarks of Apple Inc., registered in the United States and other countries. PAS Nexus is not affiliated with, sponsored by, or endorsed by Apple Inc.

You agree not to misuse our Services, including but not limited to: reverse-engineering, decompiling, or disassembling our applications (except where expressly permitted by applicable law), interfering with the proper functioning of our Services, or violating any applicable laws or regulations in connection with your use of our Services.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PAS Nexus LLC does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAS NEXUS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES.

Our total aggregate liability for all claims arising from or related to these terms or the Services shall not exceed the amount you paid (if any) for the specific PAS Nexus application giving rise to the claim in the twelve (12) months preceding the date the claim arose.

You agree to indemnify, defend, and hold harmless PAS Nexus LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your misuse of our Services or violation of these Terms and Conditions.

Our website or applications may contain links to third-party websites or services. PAS Nexus LLC is not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is at your own risk and subject to those services' respective terms and policies.

We reserve the right to restrict, suspend, or terminate your access to our Services at our sole discretion, without prior notice, if we determine that you have violated these Terms and Conditions or if such action is necessary to protect the security or integrity of our Services or other users.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict-of-law principles.

Any disputes arising out of or relating to these terms shall first be attempted to be resolved through informal negotiation by contacting Legal@pasnexus.com. If the dispute cannot be resolved informally within sixty (60) days, the dispute shall be submitted to binding arbitration in Bernalillo County, New Mexico, under the rules of the American Arbitration Association.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and PAS Nexus LLC regarding the use of our Services and supersede all prior agreements, understandings, and communications, whether written or oral.

We reserve the right to modify these Terms and Conditions at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of our Services after any changes become effective constitutes your acceptance of the revised terms.
